Welcome to Art Design Gallery! By using our website and services, you agree to comply with the following terms and conditions. Please read them carefully, as they outline the rights and responsibilities of both parties.
1. General Terms
- By accessing and using our website, you confirm that you are at least 18 years old or have parental consent for use.
- All purchases made through our website are subject to availability and acceptance.
2. Product Information
We strive to ensure accurate product descriptions and images. However, slight variations in color, dimensions, or design may occur due to screen settings or material differences. Custom-made products are crafted to your specifications and may have unique characteristics.
3. Payment Terms
- Payment must be completed in full at the time of purchase.
- Accepted payment methods include credit/debit cards, PayPal, and other payment gateways listed on our website.
- In case of payment failure, the order will not be processed.
4. Pricing and Order Acceptance
- All prices displayed on the website are in Australian Dollars (AUD) and include GST. Prices may change at any time without notice.
- Placing an order is an offer to purchase, not an acceptance. A contract of sale is formed only when we confirm your order for dispatch or pickup in a follow-up email — the automated order receipt you receive immediately after checkout is not confirmation of acceptance.
- Where a genuine pricing or stock error has occurred, we may cancel the affected order at any time before dispatch. If this happens we will notify you and provide a full refund promptly.
- Where a product is shown with a struck-through price alongside a lower price, the struck-through price is our standing price for that product when it is not on promotion.
5. Backorders and Dispatch Estimates
- Some items can be ordered in quantities greater than the stock we hold. Where that happens, your order confirmation and invoice show how many units are in stock now and how many are on backorder.
- Dispatch estimates shown on the website, in your order confirmation and on your invoice are worked out from the stock arrival dates our supplier gives us, plus the time we need to receive and pick your order. They are estimates, not guaranteed dispatch or delivery dates.
- If an estimated date changes, we will contact you by email, SMS or phone with the updated date.
- If a backorder is delayed well beyond the estimate you were given, we will talk through the options with you, which may include cancelling the backordered items and refunding them. This is handled case by case rather than by a set timeframe.
- For pickup orders, items we hold in stock can be collected as soon as they are ready, and the backordered items are collected separately once they arrive. Delivery orders are dispatched complete, in a single delivery, once all items are available.
- Backordered items are paid for in full at checkout, at the price shown at the time you ordered.
6. Order Cancellations
For normal, non-custom stock orders, a customer may request cancellation before dispatch or collection. Cancellation is not automatic. Where permitted by law, Art Design Gallery may approve or refuse the request. If approved, reasonable administration, handling, transport and logistics costs actually incurred may be deducted before any remaining balance is refunded.
Once goods have left the warehouse, a driver has departed, freight has been booked, or dispatch preparation has materially commenced, cancellation may be refused or accepted subject to reasonable costs actually incurred, including delivery, return transport, driver call-out, loading or unloading, handling, warehouse and administration costs.
For an online backorder displaying an estimated dispatch date, a customer may request cancellation at least seven days before the current estimated dispatch date. The order must not have entered dispatch preparation, no unrecoverable supplier or logistics costs may have been committed, and ADG approval is required. Requests within seven days are at ADG’s discretion.
Custom, special and personalised orders are generally non-cancellable and non-refundable once accepted and/or committed to a supplier or manufacturing process, except where ADG agrees otherwise or where the Australian Consumer Law requires a remedy. Deposits may be retained to the extent reasonably necessary to cover committed supplier, manufacturing, ordering, administration, transport, design, customisation or other reasonable costs or losses where lawful.
7. Intellectual Property
All content on the Art Design Gallery website, including images, text, graphics, and designs, is the exclusive property of Art Design Gallery. Unauthorized reproduction, distribution, or use of our intellectual property is strictly prohibited.
8. Shipping and Delivery
- Delivery timelines are estimates and may vary due to unforeseen circumstances.
- We are not responsible for delays caused by courier services or customs.
- Customers are responsible for providing accurate delivery information.
Automatic delivery prices are offered only to selected Melbourne metropolitan postcode areas. The available rate and delivery option are shown at cart or checkout after the delivery postcode is entered. Outside those areas, free pickup remains available and customers may contact us about collection or arranging their own courier.

9. Returns and Refunds
See the Returns, Refunds & Cancellations Policy. Nothing in these Terms excludes, restricts or modifies rights that cannot lawfully be excluded under the Australian Consumer Law.
10. Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any liability or remedy that cannot lawfully be excluded, restricted or modified. Subject to that, Art Design Gallery is not liable for indirect, incidental or consequential loss arising from use of products or the website, or losses due to incorrect use of products.
11. Governing Law
These terms and conditions are governed by the laws of Australia. Any disputes arising from these terms will be resolved in accordance with applicable Australian law.
12. Changes to Terms and Conditions
Art Design Gallery reserves the right to update these terms and conditions. Any changes will be posted on this page and will take effect immediately.
